#2 - Notice specific to Lawful use of KT products, waiver of liability, and disclosures

#2 - Notice specific to Lawful use of KT products, waiver of liability, and disclosures

When you purchase and/or use merchandise and/or products from KT MECH LLC (kt-mech.com), you agree to and assume all risks related to and/or arising from your ownership and/or use of the merchandise and/or products and agree to indemnify and hold KT MECH LLC (kt-mech.com), heirs, and/or assigns harmless from any and all claims brought by any person or entity against KT MECH LLC (kt-mech.com) relating to and/or arising from your ownership and/or use of the merchandise and/or products, and any damages to yourself or anyone or any property related to and/or arising from your ownership and/or use of the merchandise and/or products. KT MECH LLC (kt-mech.com) is not responsible for any negligent use or misuse of its products. In no event is KT MECH LLC (kt-mech.com), heirs, and/or assigns liable for any damages, injuries, and/or deaths, including without limitation direct or indirect, special, incidental, or consequential damages, losses or expenses arising in connection with the use of KT MECH LLC (kt-mech.com) merchandise and/or products. Although KT MECH LLC does not sell firearms, the products that KT MECH LLC sells and provides are used in conjunction with firearms. Firearms are by design dangerous and deadly, and you the user and/or purchaser assume all risks and responsibility to keep yourself safe and everyone around you.

The hazards that can arise from using KT MECH LLC products include but are not limited to the following examples:

a. Injury to your hand or body or another person’s from making contact with KT MECH LLC products. If you inadvertently make contact with KT MECH LLC products at a significant amount of force or velocity or pressure, this could result in injury or death. For instance, if you fall on the holster, the holster will typically stay rigid while your physically body is soft, this could cause you injury.

b. Damage or marring to your handgun or your person. Holsters in general make physical contact with your handgun or person in order for them to function correctly or as you intended. Over time, this could cause damage or marring to your handgun or your handgun’s finish or your person. This is typically an industry accepted risk and the most common way to avoid this risk is to not use a holster and use a soft foam lined gun case instead.

c. Accidental discharge. An object or clothing or body part can obstruct or hinder the proper functioning of the holster and/or handgun. For instance, while holstering your weapon, the obstruction can inadvertently actuate your trigger which can cause an accidental discharge. This can cause injury or death. Another instance is while drawing your handgun; your finger may land on your handgun’s trigger causing an accidental discharge. While your handgun is in the holster, your trigger may be accessible or reachable by a finger or other devices which could actuate your trigger. The holster’s gap, or opening, around your handgun’s trigger or trigger guard is minimal; however, in some setups such as weapon light compatible holsters, the gap around the trigger guard may be wider to facilitate the weapon light’s width. Almost all weapon light compatible holsters, regardless of make or brand, will have a gap around the trigger guard and you should be aware of this risk.

Holster safety is not an option; it is a requirement for using KT holsters and other products that we offer. Below are a few helpful tips to keep you safer.

#3 - Notice specific to production Lead time and Shipping

#3 - Notice specific to production Lead time and Shipping

3.1 - Our normal lead time is from the order date to shipping date, plus carrier transit times which will depend on your shipping address and may change without notice. Be sure to check the front page of our website for the most current lead time quotes before making a purchase. If you opted for the Priority Build Request the lead time is 1-3 business days (M-F) from order to shipping. Change requests on your order will extend the lead time, and potentially incur additional charges, because we have to make the changes and in some cases start your order over. Orders on hold that are waiting for clarification will also extend the lead time because we are waiting for clarification before we can proceed. You will receive a shipping notice via email from PayPal when your order is complete and being processed for shipping.

3.2 - If you are sending something in, either for a custom build, warranty, returns, exchanges, or for any other purpose, you will have to send the item(s) in using your own preferred shipping method. We do not provide labels nor return labels. We are not responsible for lost, stolen, and/or damaged items. If you do not agree to these terms, please do not send your item(s).

3.3 - For “send in” items for a custom build, such as weapon lights or attachments, KT MECH LLC or any of KT MECH LLC’s associates and representatives are not responsible in the event of lost, stolen, and/or damaged item(s). During the production process, your item(s) will come in contact with other solid objects. This is part of the process. We take great care to ensure that your item(s) stay undamaged and come back to you in the same condition, but this is not a guarantee. If you choose to send in your item, you assume all risks and losses. If you do not agree to these terms, please do not send your item(s).

#4 - Notice specific to Limited Warranty

#4 - Notice specific to Limited Warranty

KT MECH LLC fully supports its holsters. The Limited Warranty is offered only to the original purchaser of the product and it is non-transferable. The terms and exceptions are stated below. If you have any issues, just let us know and we would be happy to help. If you have a warranty claim, please let us know via email (contact@kt-mech.com).

The Limited Warranty covers manufacturing defects such as the following:

- If the holster objectively does not fit your handgun.  We will fix or replace the holster at no charge to you.  This does not mean that it is covered under warranty if you simply and subjectively dislike the fit but the holster still functions to specification.

- If the holster’s attachment points do not line up or they are out of the standard specifications as stated on our website.  We will fix or replace the holster at no charge to you.  This does not mean that it is covered under warranty because you wanted to use a 3rd party part that’s incompatible.

- If the holster was built outside of the specifications stated on our website. We will fix or replace the holster at no charge to you.  This does not mean that it is covered under warranty because you wanted a feature that we don’t offer.

The Limited Warranty does not cover normal wear and tear, lost or stolen parts, abuse, misuse, or damage that occurs after you receive delivery.  The Limited Warranty only covers the holster and/or magpouch that KT MECH LLC manufactures.  This excludes from the warranty all the parts and fasteners that KT MECH LLC did not manufacture.  The Limited Warranty does not cover shipping costs or shipping issues.  Examples of issues not covered by the Limited Warranty:

- You failed to properly secure a screw or you didn’t add thread lockers and the fastener fell out. Lost parts or fasteners are not covered under the Limited Warranty.

- You were hiking and you fell on the holster and it caused a crack. Damage you caused, or by accident, or by someone else, or to no fault of yourself, is not a manufacturing defect and they are not covered under the Limited Warranty.

- Your holster has a Safariland QLS fork that broke.  The Limited Warranty does not cover parts that KT MECH LLC did not manufacture.  You will have to contact the manufacturer of the part that’s broken and file a claim with them.

- Someone stole your holster. It is not a manufacturing defect if you lose your holster or if someone stole it. This occurrence is not covered under the Limited Warranty.

- The internal liner is starting to wear out. The internal liner is supposed to wear out because it is taking the wear in lieu of your handgun’s finish; therefore this is not covered under the Limited Warranty.

- You attempted to reform or reshape the holster with heat or force. This is not covered under the Limited Warranty because you have caused the damage to your holster.   Attempting to modify the shape or form of the holster or magpouch will void the Limited Warranty.  This is because we can’t Warranty your workmanship or the workmanship of anyone that does not work for KT MECH LLC.

- You used belt attachments that are not recommended by KT MECH LLC.  An example are the Low Profile wings.  The Low Profile wing is not necessary with the KT Gunfighter/ Defender holsters and may actually cause damage to the holster.

- You have a warranty claim and you’d like to send back the holster.  You will have to ship the holster back to us at your own expense.  The Limited Warranty does not cover shipping costs.

- Your order arrives to you later than projected because the shipping company lost the package, a natural disaster caused a delay, or other acts of god caused your holster to be late.  The Limited Warranty does not cover shipping delays or anything that is out of our control.

- Your subjective opinion or another person's opinion of how the product or holster should function is not covered by Warranty.  For example, the Level 2 retention holsters with a hood are made for the “as fast as possible” draw while also having a Level 2 hood. Any person’s subjective opinion that the hood should lean more on security than speed, or should be made in any other specific way, or should have features that it doesn’t, is not covered by Warranty.  Another example would be regarding concealable holsters.  Just because the holster is concealable, does not mean you or your body type would be able to conceal it.  How concealable a holster is is also a subjective opinion, therefore, this is not covered by the warranty.

Each situation is different and we want to hear from you and we're always happy to help. We reserve the right to replace or repair the damaged product with a similar or newer updated product if the original product is no longer available or offered. If a replacement is necessary, we will replace your item with the same specifications as the original order. For example, if you ordered a Glock 19 KT Gunfighter holster, we can only replace it with a Glock 19 KT Gunfighter holster. If you would like to receive a different model handgun holster or a different holster model, we can offer you a 50% credit of your original purchase price towards the new holster model or new model handgun holster purchase.

Additional items not covered by the warranty: Belt attachments, fasteners, straps, liners, and/or wraps are not covered by the Limited Warranty offer. The Limited Warranty applies only on KT MECH LLC holsters made after 2015. Limited Warranty does not apply to ultra light materials such as .060" grade KYDEX nor customer “send in” materials. The Limited Warranty is void if the product and/or holster is modified beyond its intended purpose such as drilling, milling, cutting, reheating, forming, reforming, Testing & Evaluation (T&E), Mil/LE/Security duty use, and/or any other similar "test to failure" activities. You can contact us anytime if you have any questions, 24-7 via email: contact@kt-mech.com

Shipping: You will have to send the product back to us using your own shipping method for any warranty repair, replacement, or service.

Mil/LE/Security duty use service agreement and discount. Since there is no Warranty on products used for Military, Law Enforcement, and Security (Mil/LE/Security), we do offer a 12% discount on these holsters. To qualify, email us any document or ID that states your name and affiliation. You’re welcome to block out any sensitive information. We don’t use coupon codes so the discount is via a 12% refund before your order is shipped. We also offer a service agreement for Mil/LE/Security customers. You can contact us anytime if you have any questions, 24-7 via email: contact@kt-mech.com

#5 - Notice specific to Thermoplastic Holster retention strength

#5 - Notice specific to Thermoplastic Holster retention strength

Thermoplastic Holsters' primary retention is via profile retention to keep your gun in. The retention strength is preset before shipping. We do not test the holster’s retention by the sound they make (audible click), we test the holster’s retention by the holster’s “retention” strength. You can also adjust the retention strength by turning the adjustable retention set screw. Each person's preferred or perceived retention strength is different. This is because each person's previous experience with holsters (or lack of) will typically determine perceived retention strength. If you're coming from a cowboy shooter holster or leather holster with minimal retention, thermoplastic holsters will feel like it's too strong. If you're a seasoned thermoplastic holster user that's accustomed to a very strong pull weight, you may perceive KT holster's to have not enough retention. Everyone is different.

For those who have limited experience with thermoplastic holsters with profile retention, in addition to keeping your finger straight and off the trigger, you will also need to place your thumb behind the slide when holstering your pistol. Placing your thumb behind the slide when holstering will ensure that your handgun does not go out of batterey. This is also explained in the safety notice shipped with your holster, or you can also find the safety notice on the bottom of any page on our website.

#6 - Notice specific to your firearm's finish

#6 - Notice specific to your firearm's finish

We at KT MEHC LLC consider firearms to be tools of the trade. Our target customers are Professionals, hobbyist, Competition shooters, and anyone who is familiar or keen on learning the trade craft. KT holsters are made of hard thermoplastic materials and may mar the finish of your firearm. If you are concerned about your handgun's finish, we do offer an internal lining service. The internal lining service is available for new holsters only.

#7 - Notice specific to returns and refunds and rentals

#7 - Notice specific to returns and refunds and rentals

7.1 - Before anything else, please know that we are always happy to help. Contact us at any time if you have any questions, concerns, or if you need any adjustments or modifications to your holster. When you order a holster, you are commissioning a work of art and labor. You are, therefore, ordering work (labor) to be done to produce the product(s) and/or item(s). Holsters are not kept in stock and they are not mass produced. Each holster is built to your specifications.

7.2 - Easy returns. If you're not happy with your holster(s) or other purchase for any reason, don't use it at the range, don't use it for training, don’t use it for Testing & Evaluation, just send the item(s) back to us for a refund within 3 days from the time you receive your order. There will be a 25% restocking/material/labor loss fee that applies to all refunds because all holsters and products are custom made for you. That means that we cannot resell them. Since we cannot resell the products, the raw materials, shipping, and the labor costs used to produce the holster are lost. Transaction fees are non-refundable because the payment processors do not refund transaction fees.

7.3 - Returned items that are used or kept longer than 3 days are considered a rental. The Rental fee is 50% of the holster’s cost for up to 30 days, plus a 50% security deposit in case of damage or loss. Once you return your rental holster in good condition, we will issue you a refund of your security deposit which is 50% of the holster’s cost (excluding non refundable items such as shipping/handling, custom mods, custom engraving, and other consumed materials and labor). If the holster is damaged or there are missing parts, then the security deposit is forfeited and will not be refunded. If the holster is not returned within 30 days after you receive it, then another 30 day rental fee is levied to your security deposit which brings the balance to zero.

7.4 - Rent/Lease - If you would like to try out a product or an item, please contact us for rental (lease) rates and fees. Contact@kt-mech.com

7.5 - There is a Cancellation grace period of 3 days from the time you place your order for standard holster builds, or 1 business day for Priority Build orders. You can cancel your order at any time within the Cancellation grace period without incurring the 25% restocking/material/labor loss fee. Once your order passes the Cancellation grace period, your order may already be in production and labor costs may have already been incurred, therefore, the 25% restocking/material/labor loss fee applies. Transaction fees are non-refundable because the payment processors do not refund transaction fees.

7.6 - Orders over $200 (USD) are considered a bulk order. Bulk orders are subject to a 25% restocking fee and have no return grace period.

7.7 – NOTICE! We get a lot of people and companies trying to sell services and/or products unsolicited. We reserve the right to refuse service to anyone. If we refuse service to you and you make a purchase anyway, we will issue you a refund minus the transaction fee and/or any other fees that are non-refundable. Please be aware that we do not welcome unsolicited sales calls nor visits. A new tactic by aggressive sales people is by making a purchase from our website, asking to come over to return the product in person, then taking advantage of the time to sell their services. This is an unwelcomed and devious device that harms our production schedules because of the wasted time. For this reason, we reserve the right to refuse service, products, and/or refunds to anyone asking to visit our production facility without paying the visitor fee (option SOP-E) as stated on the SOP Training section on our website here: https://kt-mech.com/im_sop_training.html

7.8 - Custom orders that are specifically noted to be irregular, or if you are put on notice that the build might not work as intended, or if you are put on notice that we have minimal confidence in your build request, and you otherwise ask us to proceed with the order regardless, these Custom orders are non-refundable.

7.9 - Specific to liner (suede/felt) and wraps (fabric/nylon/other). Liners and Wraps are non-refundable because they are a service that we perform. What you pay for when you order a liner and/or wrap service is the service of applying the liner and/or wrap to the holster/magpouch. This is a custom service that is unique to your order and we cannot recover the cost of application once the service is done. Similar to the shipping cost, these are services that if rendered successfully, they are consumed.

7.10 - Full Custom holsters are 50% refundable only and have no 3 day grace period. Full Custom holsters' materials are consumed on the build and cannot be reused, for this reason, they are 50% refundable only. Full Custom holster definition - Any holster that has to be modified outside of the standard specifications such as irregular cuts, custom thin materials, custom extra thick materials, or custom engravings (excludes high sight channel, full sweat guard, RMR clearance, or extended barrel clearance requests), etc., as requested by the customer.

7.11 - Duty KT AKELA, KT Wild Weasel, the KT AKELA Custom S holsters are only 50% refundable. These holsters are very popular with Law Enforcement, T&E, Training, Reviews, and Competition so you can return the holster after your event, use, or review. We will treat it as a rental and the rental price is 50% of the purchase price. This helps provide users with an easy no worries and no questions asked return policy.

7.12 - Belts, Chest Rigs, Drop Legs, and other fabric materials have a 30 day warranty against defects. Belts, Chest Rigs, Drop Legs, and other fabric materials are non-refundable and non-returnable after 3 business days from the time you receive your order. Hardware, parts, belt attachments, and fasteners have no warranty and are non-refundable.

7.13 - Mil/LE/Security duty and/or training use holsters do not have a warranty because these holsters are used as consumable items. We do offer a service agreement if you are interested in a custom coverage or special repair/replacement plan. You can contact us anytime if you have any questions, 24-7 via email: contact@kt-mech.com
